Abstract

The contribution analyses the juridical essence of canonical marriage and advocates a different configuration from the one received in the recent past, where the excessive value given to consummation, even in relation to procreation, prevailed. It highlights, therefore, the need for intervention not only by doctrine, but also by jurisprudence, in order to bring the characteristics of marriage much closer to the times; to settle the differences with other systems - both State and confessional - and to place the person at the centre of the canonical system.
