Quaderno monografico n. 1ANTONIO FUCCILLO Le intese senza intesa: nuovi modelli per la cooperazione Stato-confessioni religiose
ABSTRACT
The article, which is based on freedom of religion in Scandinavia, starts by analysing the potentially discriminatory features inherent in certain statute laws and the cases deriving from the latter. Secondly, the article addresses certain specific issues concerning the recognition of the legal personality and public funding of religious minorities in the Swedish legal system. This study also deals with elements related to the internal and external democratic nature of a community, a criterion that a religious confession should meet in order to obtain funding from the Swedish state. Finally, the article poses the question of whether, in the light of evident differences in treatment among religious communities in Sweden, one should talk of an incomplete protection of religious freedom and, as a result, determine the path to be taken in order to remove existing obstacles to the full implementation of this fundamental right.
