ABSTRACT
The article, taking its inspiration from a judgment of the Interdiocesan Ecclesiastical Court and Appeal Court of Benevento, which declared null and void a marriage contracted by two Orthodox, aims to offer a reconstruction of the main emerging legal issues concerning marriage between non-Catholics, the competence of Catholic ecclesiastical courts and applicable law, in the context of a canonical procedural order which today ’operates’ in an ecumenical horizon and whose implications, also in relation to the diversity of the matrimonial discipline of the Orthodox Churches and the other non-Catholic Eastern Churches, cannot but interest the research of the jurist and the work of the legal practitioner.
