ABSTRACT
The paper, also in the light of the indications derivable from the decision of the United Sections no. 38162 of 2022 and of the European Court of Human Rights, concludes that a right to parenthood cannot be configured in our legal system, given that its generic and indiscriminate affirmation, as envisaged by a part of jurisprudence, would lead to “super-imposing” the “desires” of adults on the “needs” of minors
