ABSTRACT
In the context of the process for the declaration of marriage nullity, the present study examines the canonical institution of retractatio – that is, the case in which due to the granting of a nova causae propositio, a sentence issued pro nullitate is overturned –, as well as considers two possible means according to Italian law for revoking the civil effects of the prior sentence, one according the Villa Madama Accords of 1984, and the other ac- cording to Italian international private law.
In the end, the author argues based on both civil and canonical jurisprudence, especially that of the Supreme Tribunal of the Apostolic Signatura, in favor of the latter solution.
