ABSTRACT
As configured by jurisprudence, the assessment of the requisites of stability and exteriority, necessary to recognize conjugal cohabitation as having actual relevance at the time of the prosecution, ends up by attributing to the judge of the prosecution, and in particular to the Courts of merit, broad discretionary powers, susceptible to significantly affect the possibility of recognition of the ecclesiastical sentence. With the further risk of the formation of differentiated orientations among the various Courts of Appeal, which the nomophylactic function of the Judge of legitimacy cannot provide for, incompetent to intervene, as happened in the present case, on questions considered engrossing assessments of fact and therefore unquestionable in the Supreme Court.
