Abstract

The essay reconstitutes the origins, role and structure of the waqf, an ancient and typical institution of Islamic law, and highlights – in its concluding part – the similarities as well as the differences with the trust. Particular attention is paid to the new functions assigned to waqf today. Reference is made, in particular, to waqf crowdfunding, which is an innovative business model aimed at promoting the socio-economic development and welfare of Muslim populations. Waqf crowdfunding differs from traditional financial instruments in that it is a socially responsible ethical model with a significant social impact. Interest in this financing model is very important in the Moroccan context, especially following the introduction of participatory banking and the crowdfunding law.
